(a) On May 29, 2024, at or near 810 3rd Avenue SW, Watford City, ND, employees were exposed to struck-by hazards while working in a trench with a depth of seven feet where the spoil pile was directly on the edge of the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c) of this section: (a) On May 29, 2024, at or near 810 3rd Avenue SW, Watford City, ND, employees installing storm sewer pipe were exposed to cave-in hazards while working in a trench with a depth of seven feet, where the sloping and benching was not properly completed.
