29 CFR 1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59) At the temporary jobsite located at 12353 Fennec Maize, KS 67101, employees performing framing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling gasoline. The chemical hazards associated with gasoline include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline can act as a fueling agent due to its extreme flammability as a liquid and vapor.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s): (Construction Reference: 1926.59) At the temporary jobsite located at 12353 Fennec Maize, KS 67101, employees performing framing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for gasoline at the job site. The chemical hazards associated with this chemical include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline can act as a fueling agents due to its extreme flammability as a liquid and vapor.

Guillermo De La Torre Gonzales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1708200, citation number 1, item number 2 and was affirmed as a final order on 01-23-2024, with respect to a workplace located at 5339 N. Pinecrest Ct. N. in Bel Aire, Kansas.
