This condition exposed employees to cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a)Hander Inc. Dba Hander Plumbing and Heating at 101 South Joseph Avenue, Tea, SD 57064: On or about and at times prior to June 6, 2024, the exposing employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not ensure an appropriate protective system was in place and did not take prompt corrective action to eliminate the cave-in hazard prior to employees entering the excavation. This condition exposed the employee to struck-by and cave-in hazards.

Dba Hander Plumbing and Heating at 101 South Joseph Avenue, Tea, SD 57064: On or about and at times prior to June 6, 2024, the exposing employer did not ensure that the Louisville A-Frame ladder, Model FS1508 Type IA, was used for it's intended purpose in that it was being utilized to exit a trench from a leaning position and not with legs fully extended and spreaders firmly locked. This condition exposes employees to fall hazards.
