29 CFR 1910.147(f)(1): When lockout or tagout devices temporarily were removed from the energy isolating device and the machine or equipment was energized to test or position the machine, equipment or component thereof, the sequence of actions were not followed in accordance with 29 CFR 1910.147(f)(1)(i)-(v): 75 Logan Street, Gardner, MA: On June 17, 2024, and at times prior, employees who cleaned glue from the rollers of the Machine Center 153 Labeler did not utilize the documented energy control procedures. Since the electrical energy source for the labeler was not isolated and locked out, Machine Operators were able to jog the Labeler rollers with a single hand, electrically operated, remote control, which exposed them to the in-going nip point hazards created by the moving rollers during jogging activities.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedures at least annually to ensure that the procedure and the requirement of this standard were being followed: 75 Logan Street, Gardner, MA: On June 17, 2024, and at times prior, the employer had not conducted an annual or more frequent periodic inspection of their established energy control procedures including but not limited to, the Machine Center 130 - Small Ward Rotary Die Cutter and the Machine center 153 - Labeler, to verify that each procedure was adequate and being used properly by employees. New England Wooden Ware Corporation was previously cited for a violation of this Occupational Safety and Health standard 1910.147(c)(6)(i), which was contained in OSHA inspection number 1464581, citation number 2, item 1-a, and was affirmed as a final order on July 16, 2020. Abatement Notes: A periodic inspection shall include the following elements: - Appointment of an authorized employee to inspect each unique procedure for inaccuracies during an actual energy control task - A review by inspector with each authorized employee, of that employee's responsibilities under each energy control procedure they are authorized to use - Certification that the periodic inspections have been performed by identifying the machines or equipment on which the energy control procedures were being utilized, the dates of the inspections, the employees included in the inspections, and the persons performing the inspections *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act
