29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Alleged Violation Description	29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  In the following instances, employees were exposed to noise levels exceeding an 8-hour time weighted average of 85 decibels measured on the A scale, or equivalently a dose of fifty percent, and the employer did not have a hearing conservation program:   a. An end cut operator was exposed to continuous noise at 366.2% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 99.3 dBA during the 387-minute sampling period on June 27, 2024; exposure calculations included a zero increment for the 93 minutes not sampled.   b. An end cut operator was exposed to continuous noise at 474.1% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 101.2 dBA during the 439-minute sampling period on June 27, 2024; exposure calculations included a zero increment for the 41 minutes not sampled.   c. A blast operator was exposed to continuous noise at 167.6% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 93.7 dBA during the 443-minute sampling period on June 27, 2024; exposure calculations included a zero increment for the 37 minutes not sampled.   d. A blast operator was exposed to continuous noise at 420% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 100.4 dBA during the 451-minute sampling period on June 27, 2024; exposure calculations included a zero increment for the 29 minutes not sampled.   e. A pickle operator was exposed to continuous noise at 71.9% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 87.6 dBA during the 418-minute sampling period on June 27, 2024; exposure calculations included a zero increment for the 62 minutes not sampled.
