29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a.)  York-Seaway Industrial Products, Inc. - On or about 7/8/24, and at times prior thereto,  the company had not performed training for all forklift operators.   Employees were operating forklifts, including, but not limited to, the Hyster forklift (Serial #F108V12271V).   The last time the company performed forklift training was in 2019.    ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

York-Seaway Industrial Products, Inc. - On or about 7/8/24, and at times prior thereto,  the company had not performed a re-evaluation of forklift operators every three years.   The forklifts being operated, included, but were not limited to, the Hyster forklift (Serial #F108V12271V).  The last time the company performed forklift re-evaluations  was in 2019.    ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

The first case, which occurred on 6/26/24, did not list the object/substance that injured or made the employee ill.
