29 CFR 1910.263(c)(3): Sprocket(s) and V-belt drive(s) of bakery machinery located within reach from platform(s) or passageway(s) or located within 8 feet 6 inches from the floor were not completely enclosed: 58 Gardner St, Worcester, MA: On and before June 26, 2024, employees working the unbaked pie line were exposed to unguarded chain and sprocket hazards of the conveyor system in the area that immediately fed the freezer. On June 26, 2024, an employee received an amputation injury in the unguarded sprocket area.

29 CFR 1910.147(c)(6)(i):The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: 58 Gardner St, Worcester, MA: On and before July 2, 2024, the employer had not performed a comprehensive periodic inspection of energy control procedures for all multi-energy sources machines, including the Unbaked Pie Line, at least annually to verify that each procedure was adequate and being properly used by employees. *Abatement Notes: A periodic inspection shall include the following elements: - Appointment of an authorized employee to inspect each unique procedure for deviations and inadequacies during an energy control task - A review by inspector with each authorized employee, of that employee's responsibilities under each energy control procedure they are authorized to use - Certification that the periodic inspections had been performed by identifying the machines or equipment on which the energy control procedures were being utilized, the dates of the inspections, the employees included in the inspections, and the persons performing the inspections *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act. Table Talk Pies was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1499032, citation number 1, item number 1b and was affirmed as a final order on May, 3 2021, with respect to a workplace located at 25 Southgate St, Worcester, MA.
