29 CFR  1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer.   a) Bag House of Margo Gardens Stateline Mulch: On or about July 2, 2024 the employer exposed employees to respiratory hazards in that a written respiratory protection program was not available to employees who were exposed to respirable crystalline silica dust and were required to wear respirators for rock and mulch production line duties.

29 CFR  1910.1053(f)(2)(i): The employer did not establish and implement a written exposure control plan that contained at least the following elements: a description of the tasks in the workplace that involve exposure to respirable crystalline silica; a description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; and a description of the housekeeping measures used to limit employee exposure to respirable crystalline silica.  a) Bag House of Margo Gardens Stateline Mulch: On or about July 2, 2024 the employer exposed employees to respirable crystalline silica in that an exposure control plan was not provided for employees with reasonable expectation to have respirable crystalline silica exposure while performing job duties in the Bag House. One employee was exposed to 28 �g/m3 respirable crystalline silica as an 8-hour time-weighted average, which is 1.12 times the action level.

29 CFR  1910.1053(h)(2)(i): The employer allowed compressed air to be used to clean clothing or surfaces where such activity could contribute to employee exposure to respirable crystalline silica without being used in conjunction with a ventilation system to capture blown dust:   a)  Bag House of Margo Gardens Stateline Mulch: On or about July 2, 2024 the employer exposed employees to respirable silica hazards in that employees were not provided with a ventilation system that effectively captured any dust cloud created by using compressed air for cleaning the Rock Bag Line.
