1960.8(a) (5)(a)(1) The head of each agency shall furnish to each employee employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm. (a)On or about June 25, 2024, at 3602 SR 143,Elmore County, Alabama, Alabama Roof Pro failed to instruct its superintendents in the recognition and avoidance of unsafe conditions at heights and the regulations applicable to the work environment at said site to assist subcontractors in controlling or eliminating any hazards or other exposure to illness or injury to subcontractor employees. Among other methods, feasible and acceptable means of abatement that would materially reduce the hazard include training superintendents in the recognition and avoidance of unsafe conditions at heights and the applicable regulations.

29 CFR 1926.502(i)(4):All covers were not color coded or marked with the word "HOLE" or "COVER" to provide warning of the hazard: a) At 3062 SR 143, Elmore AL: On or about June 25, 2024 and at times prior thereto; the employer exposed subcontracted employees to fall hazards of approximately 26 feet and 6 inches to the concrete below in that employees were performing roofing activities around a hole for which the cover was not appropriately marked or color coded to provide warning of the hazard.
