29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about July, 9, 2024 at the Intersection of Commercial St. and Professional Plaza, Neenah, Wisconsin: the employer failed to ensure that employees used a ladder with side rails extending three feet above the upper landing surface to access and exit a trench, exposing them to fall hazards of seven feet.

29 CFR 1926.652(b)(3)(iii):At least one copy of the tabulated data which identifies the registered professional engineer who approved the data, shall be maintained at the jobsite during construction of the protective system. After that time the data may be stored off the jobsite, but a copy of the data shall be made available to the Secretary upon request. On or about July 9, 2024 at the Intersection of Commercial St. and Professional Plaza, Neenah, Wisconsin: the tabulated data for a Trench shield used for cave-in protection for employees working in a trench was not available at the worksite
