29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) On or about July 10, 2024, at an apartment complex located at 215 East Arbor Avenue in Bismarck, North Dakota, employees were working on an apartment roof without wearing impact-resistant eye or face protection, while another an employee was using a pneumatic nail gun, putting them at risk for flying particles that could injure their eyes and faces.

29 CFR 1926.501(b)(10):  Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system; or, on roofs 50 feet (15.25 m) or less in width, the use of a safety monitoring system alone:   (a) On or about July 10, 2024, at an apartment complex located at 215 East Arbor Avenue in Bismarck, North Dakota, employees were exposed to fall hazards of over 6 feet while engaged in re-shingling a roof without using a fall protection system.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1598814, Citation 1, Item 1, and was affirmed as a final order on September 12, 2022, with respect to a workplace located at 620 North Nineth Street in Bismarck, North Dakota.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1704806, Citation 2, Item 1, and was affirmed as a final order on December 28, 2023, with respect to a workplace located at 613 11th Street in Bismarck, North Dakota.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:  (a) On July 10, 2024, at an apartment complex located at 215 East Arbor Avenue in Bismarck, North Dakota, employees used a ladder that was set on the east apartment building, the ladder did not extend three or more above the landing surface while installing/replacing roofing material and ridge caps.  (b) On July 10, 2024, at an apartment complex located at 215 East Arbor Avenue in Bismarck, North Dakota, employees used a ladder that was set on the west apartment building, the ladder did not extend three or more above the landing surface while installing/replacing roofing material.  Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1704806, Citation 1, Item 1, with a final order date of December 28th, 2023, with respect to a workplace located at or near 613 11th Street South in Bismarck, North Dakota.
