29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On September 13, 2024, at or near 5422 Apple Creek Drive in Bismarck, North Dakota, employees were exposed to displacement hazards associated with improperly utilized portable ladders which did not extend a minimum of 3 feet above the landing surface or alternatively secured at the top with a grasping device provided. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1704806, Citation 1, Item 1, and was affirmed as a final order on December 28, 2023, with respect to a workplace located at 613 11th Street in Bismarck, North Dakota.
