29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a.  On or about July 12, 2024, at the above addressed jobsite, the employer failed to ensure that an employee required to operate a TEREX TH636C Turbo Telehandler was adequately trained to operate the powered industrial truck as demonstrated by the successful completion of a training and evaluation program.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a.  On or about July 12, 2024, at the above addressed jobsite, an employee performing residential carpentry operations from an elevated work platform resting on the forks of a TEREX TH636C Turbo Telehandler did not have the platform attached to the fork, thereby exposing the employee to fall hazards.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.   a.  On or about July 12, 2024, at the above addressed jobsite, an employee conducting residential carpentry operations from a ladder jack scaffold, nine (9) feet nine (9) inches above ground, was not provided with an access ladder, thereby exposing the employee to fall hazards.
