29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches, above the walking-working surface. The top edge height may exceed 45 inches, provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section). a) Bright Coop, Inc. Turkey Loader: On or about July 14, 2024, employees working from aerial lifts at heights over four (4) feet to load turkeys into a cage trailer were exposed to a fall hazard due to the top edge of the guardrail system measuring approximately twenty-eight (28) inches. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part shall be worn and attached to the boom or basket when working from an aerial lift: a) Bright Coop, Inc. Turkey Loader: On or about July 14, 2024, employees working from an aerial lift to load turkeys into a cage trailer were exposed to a fall hazard up to approximately eight (8) feet by not being provided with fall protection. ABATEMENT CERTIFICATION REQUIRED
