1926.503(c)(3) The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: (a) 424 Waupelani Drive, State College, PA , Lions Gate Apartments Roof - Employees removed roof shingles approximately 25 feet above grade on a 6 inch 12 pitched roof without a fall protection system in place, on or about July 17, 2024. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) 424 Waupelani Drive, State College, PA , Lions Gate Apartments Roof - Employees performed commercial roofing operations on a three story apartment building roof, the portable extension ladder did not extend 3 feet above the upper landing, on or about July 17, 2024. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
