29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a - 50 Marion Avenue, Bordentown NJ:  Workers were exposed to fall hazards, in excess of 14 feet 9 inches to the ground surface, when entering into and exiting from a residential structure's second floor using the members of the structure's exterior wall frame to hoist themselves into the structure and hold onto when exiting the structure - both occurring while the workers were outside of the structure.    These workers were not using fall protection at the time of their exposure to the fall hazards.  Observed on or about 07/17/24  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:   a- 50 Marion Avenue, Bordentown NJ: Workers were exposed to fall hazards, in excess of 14 feet 9 inches to the ground surface below,  when gaining access to and egressing from a residential structure's second floor using a portable extension ladder located approximately three feet away from the area being access to and egressed from.  Condition note on or about 07/17/24.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.   a- 48 Marion Avenue, Bordentown NJ: Workers were exposed to fall hazards, in excess of 14 feet 9 inches to the ground surface below, when accessing and egressing the second floor of a residential structure using an aluminum extension ladder containing bent and damaged rungs, bent side rails, etc. Condition observed on or about 07/17/24.
