29 CFR 1926.501(b)(13):29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  a) On February 10, 2025, at Lot #143, Wescott Way, Auburn Meadows, Smyrna, De 19977- CSHO observed employees exposed to fall hazards at two different locations across the street from one another. Employee was standing on the top of a roof truss without fall protection at elevations 20 feet or above.  The employee was working above two other employees that were exposed to fall hazards of over 12 feet on the lower roof over the concrete garage floor. The exposed employees on the lower floor were not wearing personal fall protection either.  b) On February 10, 2025, at Lot #133, Wescott Way, Auburn Meadows, Smyrna, De 19977 - CSHO observed employees walking and working on the residential structure without the use of personal fall protection. The employees were observed walking and working  approximately 14 feet above lower level.  Non-Stop Builders , Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1762504, citation number 01001, item number 1 and was affirmed as a final order on 11/29/2024, with respect to a workplace located at   50 Marion Avenue, Bordentown NJ.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On February 10, 2025, at Lot #133 Westcott Way, Auburn Meadows, Smyrna, Delaware 19977 - Employees were exposed to fall hazards when the ladder's side rails did not extend at least 3 feet above the upper landing surface. Employees were observed exposing themselves to the hazard by using the ladder to gain access to the roof .  The Non-Stop Builders Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926., which was contained in OSHA inspection number 1762504, citation number 01003, item number 3 and was affirmed as a final order on  11/29/2024, with respect to a workplace located at 48 Marion Avenue, Bordentown NJ .
