29 CFR  1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) Pegasus Trailers on or about July 1, 2024, at the address of 4003 Tiffin Ave. Sandusky, OH, the employer did not ensure that employees tasked with fastening the "upper deck" of a racing trailer were protected from falls. Employees operating in this condition were exposed to falls of 99 in. to the concrete level below.  b) Pegasus Trailers on or about July 1, 2024, at the address of 4003 Tiffin Ave. Sandusky, OH, the employer did not ensure that employees tasked with fastening the aluminum loft deck upon the racing trailer's 5th wheel were protected from falls. Employees operating in this condition were exposed to fall hazards over 79 in. to the concrete level below.  c) Pegasus Trailers on or about July 1, 2024, at the address of 4003 Tiffin Ave. Sandusky, OH, the employer did not ensure that employees tasked with installing air conditioning units from the roof level of the racing trailers were protected from falls. Employees operating in this condition were exposed to fall hazards over 13ft to the concrete level below.

29 CFR  1910.132(d)(1):The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:  a) Pegasus Trailers on or about July 15, 2024, at the address of 4003 Tiffin Ave. Sandusky, OH: The employer failed to assess the workplace for hazards that would necessitate the use of personal protective equipment. Without this assessment, employees tasked with applying the chemical "3M Primer 94" to trailers without the benefit of  hand and skin protection were exposed to dermal injuries.

29 CFR  1910.132(f)(1):The employer did not provide training to each employee who is required by this section to use personal protective equipment:  a) Pegasus Trailers on or about July 15, 2024, at the address of 4003 Tiffin Ave. Sandusky, OH, the employer failed to provide personal protective equipment training in a workplace where hazards are present that would necessitate the use of PPE.  Without providing employee training and information on PPE selection and use, employees applying 3M Primer 94 were exposed to hazards such as but not limited dermal injuries.

Employees  applying "3M Primer 94" to trailers without the benefit of appropriate skin/hand protection were exposed to dermal injuries.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Pegasus Trailers on or about July 15, 2024, at the address of 4003 Tiffin Ave. Sandusky, OH, the employer failed to provide hazardous communication training prior to assigning employees with tasks involving the application of "3M Primer 94." Without the aforementioned training,  employee handling the product were not benefited with the information necessary to make informed decisions regarding safe use.
