29 CFR 1910.106(e)(6)(ii):Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with. a) On or about October 4th, 2024 the employer Pegasus Trailers, Inc. located at 4003 Tiffin Avenue Sandusky, Ohio 44870, failed to provide a way for employees to sufficiently bond the metal tank for chemical product referred to as Painters Pride Products Cleaning Solvent W5505 located in the work area of the paint booth spraying operations of the facility. Insufficient bonding of the Category 2 flammable liquids tank can initiate the generation of static sparks which can ignite the liquid when its being transferred, exposing employees to fire hazards.

29 CFR 1910.134(c)(1):In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: a) On or about October 4th, 2024, the employer Pegasus Trailers, Inc located at 4003 Tiffin Avenue Sandusky, Ohio 44870, the employer failed to develop and implement a written respiratory protection program for the employees working in the paint booth work area. Lack of development and implementation of a respiratory protection program poses the potential to exacerbate any pre-existing conditions in that the employees are not medically evaluated to use the respirator and health hazards associated with lack of program and training could result in exacerbation of respiratory conditions, included but not limited to shortness of breath, chest pains, wheezing, in addition to skin irritations and in severe instances claustrophobia.

The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. a) On or about October 4th, 2024, the employer Pegasus Trailers, Inc located at 4003 Tiffin Avenue Sandusky, Ohio 44870, the employer failed to provide employees mandated to wear a respirator in the workplace with a medical evaluation to determine the employee's ability to wear a respirator without posing the risk to exacerbate underlying medicals conditions such as but not limited to shortness of breath, chest pains, wheezing, in addition to skin irritations and in severe instances claustrophobia.

29 CFR 1910.134(k):Training and information. This paragraph requires the employer to provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so. a) On or about October 4th, 2024 the employer Pegasus Trailers, Inc located at 4003 Tiffin Avenue Sandusky, Ohio 44870, the employer failed to provide employees engaged in paint booth spraying operations mandated to wear respirators or employees voluntarily wearing respirators, with training associated with respiratory hazards and respirator use. Even if exposures remain below the PEL, training is necessary to ensure workers are able to recognize hazards, comprehension of underlying medical conditions and the impact it could have on respirator usage, implement proper use of PPE if necessary, and have an understanding of the risks associated with respiratory exposure.
