General-duty citation text
29 CFR 1910.242(a): Hand and portable powered tools or equipment were not kept in safe condition: (a) Maintenance Building - The employer did not keep tools and equipment in safe condition in that employees used a handcrafted cutting jig on the DeWalt DW744 table saw (serial number 4962 2011 34-49 X) to fabricate circular shaped swimming pool skimmer covers out of square shaped pieces of plastic composite material, which required removing the saw blade guard and involved sliding the cutting jig with the right hand while holding the work piece with the left hand to push and pull the work piece through the running saw blade while making non-through cuts to the underside of the work piece, exposing the employee operating the saw to the hazard of contacting the saw blade, as occurred on July 22, 2024 when the saw blade grabbed and wrenched the plastic work piece, resulting in laceration and amputation injuries to the saw operator's left hand. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.
