29 CFR  1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  Welding and Fabrication Shop: On and/or before July 24, 2024, employees conducted arc welding on steel and aluminum for longer than 60-minute periods during equipment maintenance and were required to wear a 3M N95 respirator due to inoperable ventilation controls. The employer had not evaluated employee exposures via personal sampling during the time of inoperable ventilation and for periods longer than 60 minutes to reasonably estimate the employee's exposure which potentially exposed employees to metal fumes inhalation hazards.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  Welding and Fabrication Shop: On and/or before July 24, 2024, employees conducted arc welding on steel and aluminum for longer than 60-minute periods during equipment maintenance and were required to wear a 3M N95 respirator due to inoperable ventilation controls. The employer did not provide initial fit tests for the 3M N95 respirator worn which potentially exposed employees to metal fumes inhalation hazards.

29 CFR  1910.134(k)(1): The employer did not provide effective training to employees who were required to use respirators:  Welding and Fabrication Shop: On and/or before July 24, 2024, employees conducted arc welding on steel and aluminum for longer than 60-minute periods during equipment maintenance and were required to wear a 3M N95 respirator due to inoperable ventilation controls. The employer did not provide respirator protection training to ensure the employee could demonstrate proper use including donning/doffing and to understand the limitations of respirators used. The employees were potentially exposed to metal fume inhalation hazards.

29 CFR  1910.95(i)(4): The employer did not provide training in the use and care of all hearing protectors provided to employees:  Welding and Fabrication Shop, Motor Transportation Shops: On and/or before July 24, 2024, employees conducted vehicle repairs, welding, fabrication, and cutting operations during equipment maintenance and were required to wear single hearing protection (3M Optime 98 earmuffs). The employer had not provided training in the use and care of hearing protectors and ensured cleaning procedures occurred which potentially exposed employees to bacterial growth and ear infections.
