Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from dust collectors being located inside a building and ineffective dust collection and fire protection systems:  On or about October 3, 2024, it was observed that the employees were exposed to potential fire hazards such as explosions or deflagrations caused by combustible dust conveyed through the 2 HP,5 Micron, 70 gallon Dust Collector system.     a) Saw Area Dust Collection System /The Front, Center and Back End table saws- The interior of the duct collecting dust, generated by sawing was not clean and free of residual material,  b) Saw Areas and Dust Collection System - These systems had dust collection drums connected to baghouse after filters that were not airtight.    Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.22(a)(1): All places of employment were not kept clean:    a) Saw and Grinding Rooms:  On or about October 2, 2024, and dates prior, employees were exposed to a fire hazard as the areas where wood products are sawed had accumulations of combustible dust on surfaces including the floors, walls, and electrical equipment.    Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:   a) 21498 Baltimore Avenue Georgetown, DE: On or about October 2, 2024the employer did not establish and implement a comprehensive written respirator protection program that includes procedures for selecting respirators for use in the workplace.  Medical evaluations of employees required to use respirators; fit testing procedures for tightfitting respirators;  procedures for proper use of respirators;  procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators; training of employees in the respiratory hazards to which they were potentially exposed;  training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and procedures for regularly evaluating the effectiveness of the program.
