29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about August 14, 2024, at 4470 Ridge Road, Brooklyn, Ohio, during the installation and removal of roofing material on a church, the employer did not ensure portable ladders extended 3 feet above the upper landing surface.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed on August 14, 2024, at 4470 Ridge Road, Brooklyn, Ohio, where two employees were not protected from fall hazards of approximately 9 feet, 8 inches from the roof to the ground, while carrying roofing material on a roof with a pitch of less than 4/12. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof six feet or more above lower levels without adequate fall protection. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps they are taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.

The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed on August 14, 2024, at 4470 Ridge Road, Brooklyn, Ohio, where three employees were not protected from fall hazards of 30 feet or greater to the ground, while removing and installing roofing material on a roof with a pitch of 9/12. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof six feet or more above lower levels without adequate fall protection. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps they are taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.

The employer did not provide written certification of training in fall protection for their employee.
