29 CFR 1926.416(a)(1): The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work: a) Worksite: 78 Burns Avenue, Hicksville, NY 11801 - An employee was exposed to electrical hazards while working on a residential roof within one foot of 240 Volt energized wires for service to a residential home; on or about 08/14/24. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Worksite: 78 Burns Avenue, Hicksville, NY 11801 - Employees were installing roofing and chimney flashing on top of a one-story residential home. The employees were not protected from falling approximately 17 feet to the ground below; on or about 08/14/24. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
