29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. a) East Somerdale Sq., Somerdale NJ: An employee was exposed to hazards associated with not being connected to an articulating lift. An employee was observed operating a JLG model #400S, serial # 0300135171 and was not connected by a lanyard to the connection point on the lift. Observed on or about 08/16/24 J & T Brothers, LLC, WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD, 1926.453(b)(2)(v). WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1519366 CITATION NUMBER 2, ITEM NUMBER 1, ISSUED ON 09/01/2021. NOTE: FINAL ORDER DATE 04/07/2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
