OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   On or about August 21, 2024, at a workplace located at 111 North Douglas Street, Hortonville, Wisconsin in the production area; an employee was exposed to a fall hazard while working from a platform that was not designed and constructed to safely support personnel and was not attached to the forks to prevent falls to lower levels while the pallet was elevated by the forks of a powered industrial vehicle. The employee was exposed to a fall hazard over eight feet to the floor below.   On or about August 2, 2024, at a workplace located at 111 North Douglas Street, Hortonville, Wisconsin in the production area; employees were exposed to fall hazards while working from a platform that was not designed and constructed to safely support personnel and was not attached to the forks to prevent falls to lower levels while the pallet was elevated by the forks of a powered industrial vehicle. The employees were exposed to fall hazards over ten feet to the floor below.   On or about July 25, 2024, at a workplace located at 111 North Douglas Street, Hortonville, Wisconsin on the exterior of the building; an employee was exposed to a fall hazard while working from a platform that was not designed and constructed to safely support personnel and was not attached to the forks to prevent a fall to lower levels while the pallet was elevated by the forks of a powered industrial vehicle; The employee was exposed to a fall hazard over ten feet to the floor below.

29 CFR  1910.28(b)(1)(i): Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:    On or about August 20, 2024, at a workplace located at 111 North Douglas Street, Hortonville, in the Production Area; employees standing on the metal sorting table positioned in front of the shredder conveyor were not protected from a fall hazard of four feet.

29 CFR  1910.147(f)(3)(ii)(D): Each authorized employee shall affix a personal lockout or tagout device to the group lockout device, group lockbox, or comparable mechanism when he or she begins work, and shall remove those devices when he or she stops working on the machine or equipment being serviced or maintained:   On or about August 21, 2024, at a workplace located at 111 North Douglas Street, Hortonville, WI in the Production Area; each employee engaged in a servicing task of removing a heater assembly from the extruder did not affix a personal lockout device to the energy disconnect.
