29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation.  On August 22, 2024, at the above mentioned address, employees of Cesar Ignacio Medina dba Lara Construction were exposed to eye injury while operating pneumatic nail guns without eye protection.  No abatement certification or documentation is required for this item.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were the employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) On or about August 22,2024 at the above-mentioned address, the employees were exposed to fall hazards of approximately 13 feet ground to eave while performing residential roofing work.  b) On or about August 22,2024 at the above-mentioned address, the employees were exposed to fall hazards of approximately 8 feet ground to eave while performing residential roofing work.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
