29 CFR 1910.28(c):When an employee was exposed to falling objects, the employer did not ensure that each employee wore head protection that met the requirements of subpart I of this part. In addition, the employer did not protect employees from falling objects by implementing one or more of the following: (1) Erecting toeboards, screens, or guardrail systems to prevent objects from falling to a lower level; (2) Erecting canopy structures and keeping potential falling objects far enough from an edge, hole, or opening to prevent them from falling to a lower level; or (3) Barricading the area into which objects could fall, prohibiting employees from entering the barricaded area, and keeping objects far enough from an edge or opening to prevent them from falling to a lower level: a) Jobsite - On or about August 14, 2024 the employer did not protect employees from falling objects while maintenance was working on equipment above them, exposing employees to struck-by hazards.

OSH ACT of 1970 Section (5)(a)(1) Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a falling object. a) Jobsite - On or about August 14, 2024, the employer did not ensure that the motor at the Debone Front Half Belt Transfer Belt was properly handled to ensure that it would not fall.

29 CFR 1910.157(c)(4):The employer did not assure that portable fire extinguishers were maintained in a fully charged and operable condition and kept in their designated places at all times except during use: a) Jobsite - On or about August 19, 2024 the employer did not ensure that the fire extinguisher below the front half transfer belt near the cone lines was kept in it's designated location, exposing employees to smoke inhalation and delayed exit in the event of a fire.
