29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of the support system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the support system. On or about August 22, 2024, at the excavation site on the east side of S Eastern Ave., an employee was spreading gravel in a trench and the bottom of the trench box was more than two (2) feet from the bottom of the trench.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support). On or about August 22, 2024, on the north end of the trench, an employee exited the trench by using a non-self supporting ladder that was not positioned at an angle of approximately one-quarter the working length from the top support to the foot of the ladder.
