29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On August 23, 2024, employees engaged in carpentry work were not protected from fall hazards of approximately 20 feet to the ground while working from the external wall's top plate and joists. b) On August 23, 2024, employees engaged in carpentry work were not protected from fall hazards of approximately 8.5 feet to the inside of the new room addition while working from the joists. c) On August 23, 2024, employees engaged in carpentry work were not protected from fall hazards of approximately 9 feet to the ground while carrying material up to the roof. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
