29 CFR 1910.1200(e)(1):Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: A) In the office, there was a spray bottle that contained a clear solution that had a distinct chemical aroma as well as a bottle of Sanitizer. The employer did not have a written chemical hazard communication program in place. Employees could use the chemical without knowledge of its nature and be exposed to hazards.

29 CFR 1910.1200(f)(6):Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked: A) On or about August 26, 2024, employees were exposed to health hazards. In the office, there was an unlabeled spray bottle with a clear liquid that had a distinct chemical aroma. The employer was unable to determine precisely what was in the bottle, though it was thought to be an alcohol based sanitizer used to clean surfaces in the office.

29 CFR 1910.1200(g)(8):The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). A) On or about August 26, 2024 In the office, employees performing cleaning activities were exposed to an unknown chemical, believed to be a sanitizer. Employees were exposed to this hazard because the employer did not have safety data sheets available to employees, nor were they able to provide one.
