29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): 1) On August 27, 2024, employees were performing framing carpentry work to a new residential structure. Employees were working from the top of the first-floor framing without utilizing fall protection. The employees were exposed to fall hazards of approximately 14.4 feet to the ground below. 2) On September 4, 2024, employees were performing framing carpentry work to a new residential structure. Employees were working from top plates without fall protection. The employees were exposed to fall hazards of approximately 25 feet to the ground below. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. 1) On August 27, 2024, an employee was utilizing a pneumatic nail gun while performing framing carpentry work and was observed to not be utilizing safety glasses or any other form of eye and face protection. 2) On September 4, 2024, an employee was operating an electric saw while performing framing carpentry work and was observed to not be utilizing safety glasses or any other form of eye and face protection. Hernandez Reyes Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1) which was contained in OSHA inspection number 1749671, citation 1, item 1, and was affirmed as a final order on August 9, 2024, with respect to a worksite located at 12 Stone Bridge Ct., Schaumburg, IL 60195. Hernandez Reyes Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1) which was contained in OSHA inspection number 1725234, citation 1, item 1, and was affirmed as a final order on April 16, 2024, with respect to a worksite located at Lot 62-21127 Preserve Dr., Hawthorne Woods, IL 60047.
