29 CFR 1910.252(a)(2)(xiii)(A): The employer did not recognize its responsibility for the safe usage of cutting or welding equipment, based on fire potentials of plant facilities, and establish areas for cutting and welding, and procedures for cutting and welding, in other areas. a) In the shop: On or about August 28, 2024, and at times prior, the employer exposed employees to burn hazards, in that use of an acetylene torch was permitted in an area with no designation as a safe area for that type of work. The employer did not provide a work permit or instructions to establish an area as safe for hot work.

29 CFR 1910.252(a)(2)(xv): Cutting or welding was permitted in an area that was not made fire safe by removing combustibles or protecting combustibles from ignition sources. a) In the shop: On or about August 28, 2024, and at times prior, the employer exposed employees to burn hazards, in that use of an acetylene torch was permitted in an area which was not made fire safe for use, in that flammable gases and vapors were present. Other flammable materials were present including: aerosol cans, cardboard boxes, shop rags and a trash can.
