29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  An effective hearing conservation program which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard was not instituted by Dario's Pallets, Corp.   a. On or about October 17, 2024, an employee in the building #2 work area, operating a trim saw was exposed to continuous noise levels at 80.6% of the action level 8-hour time-weighted average sound level of 85 dBA. The equivalent dBA level of 80.6% is approximately 88.4 dBA.  The sampling was performed for 468 minutes during one shift.    b. On or about October 17, 2024, an employee in building #2 work area, operating a saw machine was exposed to continuous noise levels at 541.7% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 541.7% is approximately 102.2 dBA. The sampling was performed for 465 minutes during one shift.   c. On or about October 17, 2024, an employee in building #2 work area, operating a notch machine was exposed to continuous noise levels at 105% of the action level 8-hour time-weighted average sound level of 85 dBA. The equivalent dBA of 105% is approximately 90.4 dBA. The sampling was performed for 468 minutes during one shift.   d. On or about October 17, 2024, an employee in building #2 work area, operating a mauler machine and loading pallets onto trucks was exposed to noise levels at 116.5% of the action level 8-hour time-weighted average sound level of 85 dBA. The equivalent dBA of 116.5% is approximately 91.1 dBA. The sampling was performed for 464 minutes during one shift.   e. On or about October 17, 2024, an employee in building #1 work area, operating a nail gun was exposed to continuous noise levels at 283.6% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA of 283.6% is approximately 97.5 dBA. The sampling was performed for 473 minutes during one shift.  f.  On or about October 17, 2024, an employee in the building #1 work area, operating a band saw was exposed to continuous noise levels at 169% of the action level 8-hour time-weighted average sound level of 85 dBA. The equivalent dBA level of 169% is approximately 93.8 dBA.  The sampling was performed for 474 minutes during one shift.    g. On or about October 17, 2024, an employee in building #1 work area, operating a nail gun was exposed to continuous noise levels at 271.1% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA of 271.1% is approximately 97.2 dBA. The sampling was performed for 473 minutes during one shift.  h. On or about October 17, 2024, an employee in building #1 work area, operating a dismantler was exposed to continuous noise levels at 263.6% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA of 263.6% is approximately 97.0 dBA. The sampling was performed for 468 minutes during one shift.
