29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. (a) On or about September 11, 2024, at a jobsite located at 2825 E. Emily Ave., Oak Creek, WI 53154, employees were operating pneumatic nail guns without eye protection while installing roof shingles. This exposed employees to struck-by and eye impalement hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about September 11, 2024, at a jobsite located at 2825 E. Emily Ave., Oak Creek, WI 53154, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the first floor roof of approximately 8.3 feet at the eave to approximately 15.5 feet at the ridge.
