29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:(a)   a. On or about September 12, 2024, at the above addressed jobsite, the portable ladder used to access the garage roof did not extend at least three (3) feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. On or about September 12, 2024, at the above addressed jobsite, an employee performing residential roofing operations, eight (8') feet one (1") inch above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  Fellows Roofing LTD. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1611188, citation number 2, item number 1 and was affirmed as a final order on December 29, 2022, with respect to a workplace located at 1413 Home Avenue, Berwyn, IL 60402.  Fellows Roofing LTD. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1496446, citation number 1, item number 1 and was affirmed as a final order on December 31, 2020, with respect to a workplace located at 2024 E. Vargo, Arlington Heights, IL 60004.

On or about September 12, 2024, at the above addressed jobsite, an employee was carrying underlayment up the ladder eight (8) feet (1) one inch, thereby exposing the employee to hazards associated with falls.  Fellows Roofing LTD. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1053(b)(22), which was contained in OSHA inspection number 1611188, citation number 1, item number 2 and was affirmed as a final order on December 29, 2022, with respect to a workplace located at 1413 Home Avenue, Berwyn, IL 60402.
