29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. On or about September 16, 2024, employees operated a Nissan forklift (Model: MCP1F1A15LV Serial: CP1F1-9N1982) with Ravas iForks 5.0 Eco 2.0 (Serial: 221013222.211601) attachments without manufacturer's prior written approval and the maintenance instruction plates, tags, and/or decals for the powered industrial vehicles had not been changed, thereby exposing employees to struck-by or other hazards associated with forklift operations.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. On or about September 16, 2024, in the warehouse, powered industrial trucks were not examined daily prior to being operated.
