29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Buildings 1 and 2, 2303 Brockett Road Tucker, GA, on or about 9/18/2024, where the employer did not enforce the use of eye protection during framing operations including but not limited to using circular saws, hammers, and pneumatic nail guns shooting 3-inch framing nails at 130 P.S.I.  Jose Angel Nolasco Dominguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1715339, citation number 1, item number 1 and was affirmed as a final order on 4/16/2024, with respect to a workplace located at 700 White Oak St. Woodstock, GA 30188.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Unprotected 1st floor: New multi-family residential construction site, building 1, 2303 Brockett Road, Tucker, GA 30084, on or about 9/18/2024 where the employer exposed employees to fall hazards of up to 11-feet, 4-inches to the lower level in that a personal fall protection system was not utilized during framing operations.  b) 2nd floor top plate: New multi-family residential construction site, building 2, 2303 Brockett Road, Tucker, GA 30084, on or about 9/18/2024 where the employer exposed employees to fall hazards of up to 19-feet, 10-inches to the lower level in that a personal fall protection system was not utilized during framing operations.  Jose Angel Nolasco Dominguez  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1715339, citation number 1, item number 2 and was affirmed as a final order on 4/16/2024, with respect to a workplace located at 700 White Oak St. Woodstock, GA 30188.
