29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Residential Structure located on Lot #002 at 1940 Smarty Jones Dr., Dacula, GA 30019, Between first and second levels: On or about 02/17/2026, the employer exposed four employees to fall hazards when using a ladder to access the second level with a height of approximately 10 feet, 2 inches to the lower level, in that the ladder side rails of the ladder used did not extend at least 3-feet past the upper landing to allow for safe access on and off the second level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New residential construction located on Lot #002 at 1940 Smarty Jones Dr., Dacula, GA 30019, Top plate: On or about 02/17/2026, the employer exposed employees to fall hazards of approximately 21 feet, 3 inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing and sheathing a residential structure.  Jose Angel Nolasco Dominguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.501(b)(13), which was contained in OSHA inspection number1796056, citation number 1, item number 2 and was affirmed as a final order on03/03/2025, with respect to a workplace located at Lot 140, 2651 Satellite Blvd, Duluth, GA 30096.  Jose Angel Nolasco Dominguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.501(b)(13), which was contained in OSHA inspection number1776119, citation number 1, item number 2 and was affirmed as a final order on 10/23/2024, with respect to a workplace located at New multi-family residential construction site, building 1, 2303 Brockett Road, Tucker, GA 30084.
