29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)Michels Road & Stone, Inc. at 2592 North Main Street, Mitchell, SD 57301:  On or about and at times prior to September 17, 2024, the controlling employer did not ensure that employees were protected from cave-ins while conducting trenching activities deeper than five feet.  Employees were conducting retaining wall operations within a vertical walled trench and no protective system in place.  This condition exposed employees to cave-in hazards from trench wall failure.
