29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  On April 20, 2026, at a worksite located on Interstate 41 between Wisconsin Avenue and Northland Avenue in Appleton, Wisconsin; the employer did not fully and properly implement:  a) Engineering controls specified in Table 1 for the task (vii), cleaning vertically drilled holes. An employee utilized compressed air to clean holes drilled into the concrete road surface instead of using a prescribed HEPA-filtered vacuum.  b) Respirator protection specified in Table 1 for the task (viii) operating dowel drilling rigs for concrete. An employee operating the dowel drill rig was not using respirator protection with an APF of 10 without regard for length of the task outdoors.

29 CFR  1926.1153(d)(2)(i): The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  On April 20, 2026, at a worksite located on Interstate 41 between Wisconsin Avenue and Northland Avenue in Appleton, Wisconsin; the employer did not assess the exposure of an employee who was or may reasonable be expected to be exposed to respirable crystalline silica (RCS) at or above the action level when an employee utilized compressed air to clean holes drilled vertically into the concrete road surface and when the employee operated a single-gang dowel drilling rig for drilling holes horizontally into the concrete road surface.
