29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  On or about September 20, 2024, at the job site located at 25136 177th Terrace Gardner, Kansas, employees engaged in residential framing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling, diesel fuel, which is a category 3 flammable liquid, an irritant as well as a category 2 carcinogen. The employees were also using Titebond Pros Advantage, which is an eye irritant, reproductive toxicant and also flammable.  Five Star Framing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(e)(1), which was contained in OSHA inspection number 1704902, citation number 1, item number 1 as affirmed as a final order on 01/24/2024, with respect to a workplace located at Parkside reserve lot 20, Olathe Kansas 66061.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59).   On or about September 20, 2024, at the job site located at 25136 177th Terrace Gardner, Kansas, employees engaged in residential framing activities were exposed to chemical hazards of diesel and Titebond Pros Advantage which are irritants, flammable and reproductive toxicants. The employer did not maintain copies of the required safety data sheets.   Five Star Framing, LLC previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(g)(8), which was contained in OSHA inspection number 1704902, citation number 1, item number 2 and was affirmed as a final order on 01/24/2024, with respect to a workplace located at Parkside reserve lot 20, Olathe, Kansas, 66061.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about September 20, 2024, at a jobsite located at 25136 177th Terrace in Gardner, Kansas, employee(s) engaged in residential framing activities were exposed to fall hazards of approximately 9 feet from the eave of the roof to the level below in that fall protection was not utilized.  Five Star Framing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1703512, citation number 1, item number 2 and was affirmed as a final order on 01/24/2024, with respect to a workplace located at Parkside Reserve, lot 20, 16735 Olathe, Kansas.
