29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access:  location: scaffold erected on 1st level on or about: 8/30/24  a) Employees were using a tubular welded frame scaffold to access/egress the work area. The employees were not provided with adequate access. The employees were climbing the walk through frames and crossbraces of the scaffold. There was no midrail. 29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  Location: upper levels of building being demolished On or about: 8/30/24  a) State Contracting Corp. Of NY DBA Capital Construction Corp. does not ensure that each employee uses fall protection while engaged in demolition activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about August 30th, 2024, at 27-45 North Main St., Port Chester, NY 10573 when employees, demolishing a building, were not provided with any means of fall protection.  The employees were exposed to a fall hazard of between 10 and 26 ft.  NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.  The Capital Construction Corp.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(1)), which was contained in OSHA inspection number 1700844, citation number 1, item number 1 and was affirmed as a final order on 11/6/2023, with respect to a workplace located at 251 East Main St., Elmsford, NY 10523.
