29 CFR  1926.451(g)(3)(i): Vertical lifelines were not fastened to a fixed safe point of anchorage, independent of the scaffold, and protected from sharp edges and abrasion.  a) Building 5 - Link @ W Squared, West Windsor NJ: The anchor point used for an employee's Personnal Fall Arrest system was a structural member within the top buck of a prefabricated, tubular welded framed scaffold's end frame exposing this employee to crushing and fall hazards (in excess of 11 feet 9 inches to the ground surface below) . Observed on or about 09/30/24.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) Building 5 - Link @ W Squared, West Windsor NJ:  Company worksite employees were exposed to fall hazards, in excess of 13 feet 3 inches & in excess 15 feet to the ground surface, when working/walking from a supported scaffold whose end frame openings were not supplied with guarding. Observed on or about 09/30/24.  b) Building 5 - Link @ W Squared, West Windsor NJ:  Company worksite employees were exposed to fall hazards, in excess of 11 feet 9 inches & in excess of 18 feet the ground surface, when working/walking from a supported scaffold side brackets's that were not provided with end stops. Observed on or about 09/30/24.  c) Building 5 - Link @ W Squared, West Windsor NJ:  A company worksite employee was exposed to fall hazards, in excess of 13 feet 3  inches to the ground surface, when working/walking from a supported scaffold whose walking/working surface was not supplied with mid rails. Observed on or about 09/30/24.  d) Building 5 - Link @ W Squared, West Windsor NJ:  Company worksite employees were exposed to fall hazards, in excess of 14 feet 6  inches to the ground surface, when working/walking from a supported scaffold's whose walking/working surface was not supplied with top rails. Observed on or about 09/30/24. 29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)   a) Building 5 - Link @ W Squared, West Windsor NJ.:  On or about 09/30/24 company employees were exposed to fall hazards, in excess of 13 feet 3 inches & 15 feet to the ground surface below, when working and walking from the second and third buck of supported scaffolds whose walking/working surface were not fully planked.  KR Contractors, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.451(b)(1)), which was contained in OSHA inspection number 1661594, citation number 1, item number 2 and was affirmed as a final order on 08/21/23, with respect to a workplace located at 115 Main Street, Little Falls NJ.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
