OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:   On or about October 1, 2024, at a job site located at 4000 East Brown Deer Road, Bayside, WI 53217, an employee was exposed to a fall hazard of approximately 9 feet while using the load area surface of an Equipter RB4000, as a means of access to the Equipter RB4000 from the commercial roof.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation  (a) On or about October 1 , 2024, employees were operating a pneumatic nail gun without eye protection while installing decking on the north side of existing commercial roof, exposing the employees to a struck by / eye injury hazard.  (b) On or about October 1 , 2024, employees were operating a pneumatic nail gun without eye protection while installing shingles on the northeast side of existing commercial roof, exposing the employees to a struck by / eye injury hazard.

29 CFR 1926.300(b)(2):  Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus.  (a) On or about October 2, 2024, employee(s) used an extension ladder hoist to convey materials up to the roof. The hoist did not have the power transmission pulley and belt guarded, exposing employees to a caught-in hazard and amputation hazard.

29 CFR  1926.452(k)(2): All ladders used to support ladder jack scaffolds shall meet the requirements of subpart X of this part -- Stairways and Ladders, except that job-made ladders shall not be used to support ladder jack scaffolds.  (a) On or about October 1, 2024, employees installing decking on the north side of commercial roof, used a Werner 28-foot fiberglass ladder (Model: D6228-2) to set up a ladder jack scaffold system in which the Werner 28-foot extension ladder was taken apart to create  the two ladder legs of the scaffold system. This exposed the employees to  an approximately 8-foot fall hazard, in that the ladder legs were not designed for separate use and did not meet subpart X.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a) On or about October 1, 2024, employees tear off work on the south side of a commercial roof with a 10:12 pitched, were not using fall protection. This exposed employees to a fall hazard of approximately 10 feet from roof to the ground below.  (b) On or about October 1, 2024, employees conducting roofing work on the north side of a commercial roof with a 10:12 pitched, were not using fall protection. This exposed employees to a fall hazard of approximately 10 feet from roof to the ground below.

29 CFR  1926.503(b)(1): The employer did not verify fall protection training by preparing a written certification record.  (a) On or about October 1, 2024, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work. This exposed employees to a fall hazard of approximately 10 feet off the roof, and 8 feet off an elevated Equipter RB4000 dump trailer.
