29 CFR  1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.   On or about October 1, 2024, the employer did not provide personal protective equipment such as but not limited to, eye or face protection, gloves, or apron when adding water to batteries of the forklifts.

29 CFR  1910.151(c):Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. [63 FR 33450, June 18, 1998]  On or about October 1, 2024, the employer did not provide facilities that were suitable for flushing the eyes when employees added water to forklift batteries.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a. On or about October 1, 2024, guarding was not in place at the Davi Roller to prevent employees from reaching into or getting caught in the ingoing nip point of the rollers.  b. On or about October 1, 2024, guarding was not in place at the Lown Roller to prevent employees from reaching into or getting caught in the ingoing nip point of the rollers. On or about June 17, 2024, an employee was putting strips of metal through the Lown Roller when their hand was pulled in causing an amputation to the finger.   c. On or about October 1, 2024, guarding was not in place at the Tanaka 4000-watt laser cutter to prevent employees reaching into the point of operation where the laser cut the metal.

29 CFR  1910.252(b)(2)(iii): Protection from arc welding rays. Where the work permits, the welder should be enclosed in an individual booth painted with a finish of low reflectivity such as zinc oxide (an important factor for absorbing ultraviolet radiations) and lamp black, or shall be enclosed with noncombustible screens similarly painted. Booths and screens shall permit circulation of air at floor level. Workers or other persons adjacent to the welding areas shall be protected from the rays by noncombustible or flameproof screens or shields or shall be required to wear appropriate goggles.  On or about October 1, 2024, employees were not protected from arc welding rays while employees welded on electric casings.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  The employer did not report an employee hospitalization within 24 hours of being aware of the hospitalization. On or about June 17, 2024, an employee was hospitalized after their hand was pulled into the Lown Roller G500.
