OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a) 1150 Kingsley St, Asbury Park, NJ - An employee, Foreman, working for the company passed under the elevated portion of the JLG Rough Terrain Forklift Truck, Model 1044C- 54 Series II lifting with an unstable load of wooden truss bundles, held aloft with the forks. The employee suffered severe head and spine injuries when the unstable bundle of wooden trusses struck the employee in the head. This condition was noted on or about October 2, 2024.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The employee was injured on the jobsite then hospitalized September 24, 2024, OSHA received notification of the hospitalization on October 1, 2024. This condition was noted on or about October 1, 2024.  NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
