29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a)  On or about October 9, 2024, the employer did not ensure that employees using pneumatic nail guns were wearing eye protection equipment.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  On or about October 9, 2024, employees conducting roofing work on a new residential property with a 6:12 pitch roof, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 10 feet over the garage and 20 feet over the backside of the residential property.

29 CFR  1926.503(c)(3): 29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee.  (a)  On or about October 9, 2024, the employer did not ensure employees exposed to potential fall hazards had been properly trained to recognize and minimize the fall hazards associated with their work.  This is to include proper installation of anchor points and the proper selection of fall protection equipment.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a ) On or about October 9, 2024, the employer did not ensure the two Hart Multi-positioning ladders used by employees to access the roof of the residential home extended at least three feet above the upper landing, exposing employees to a fall hazard of approximately 10 feet to the ground below.
