29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. On or about October 10, 2024, at the worksite located at N4085 County Road M, Waldo, Wisconsin; employees working from a JLG aerial lift (Model No.: 450AJ, Serial No.: 0300115214) were exposed to a fall hazard of over 20 feet without utilizing the required fall protection system. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.760(a)(1):Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On or about October 10, 2024, at the worksite located at N4085 County Road M, Waldo, Wisconsin; the employer did not ensure that employees were protected from fall hazards while performing steel erection construction activities. Employees were exposed to the hazard of falling up to approximately 20 feet when they were working on a roof to install a metal decking roof over the existing shingles and they were not protected using a conventional fall protection system.

29 CFR 1926.760(d)(1): Guardrail systems, safety net systems, personal fall arrest systems, positioning device systems and their components shall conform to the criteria in �1926.502 (see Appendix G to this subpart). On or about October 10, 2024, at the worksite located at N4085 County Road M, Waldo, Wisconsin; the employer failed to ensure fall arrest systems conformed to the criteria in 1926.502. Specifically, the employer failed to ensure the anchor used, a Zinc Plated Formed Lag Screw, conformed to 1926.502(d)(15), in that it was not a designed anchor point capable of supporting 5000 lbs.
