29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. On or about October 10, 2024, and at times prior thereto, located in the basement and grinding area, a written respiratory protection program was not established when employees were required to wear a respirator while performing dust cleaning and brick grinding work operations.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. On or about October 10, 2024, and at times prior thereto, located at Acme Brick Co, employees were required to wear a tight fitting N95 respirator without first being medically evaluated to wear a respirator.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about October 10, 2024, and at times prior thereto, located on the kiln, employees operated the kiln and the rotating parts of the motor supplying air to the kiln were not guarded.
